The Government Will Help
Pay for Your Compliance.
Qualifying small businesses can offset up to $20,000 per year in ADA compliance costs through two permanent IRS tax incentives. Your net cost of protection may be far lower than you think.
A dollar-for-dollar tax credit — not a deduction — equal to 50% of eligible access expenditures between $250 and $10,250. This directly reduces your tax bill, not just your taxable income.
A business expense deduction for costs incurred removing accessibility barriers — including digital barriers like inaccessible websites. Stackable with the Section 44 credit in the same tax year.
Tax incentives vary by situation. Consult your tax advisor to confirm eligibility. Based on current IRS guidance.
What This Means For You
Your Net Cost of Compliance Could Be Dramatically Lower Than You Expect
Compare that to the average $25,000+ cost of a single ADA lawsuit — attorney fees, defense costs, and court-ordered remediation — with zero tax benefit. Proactive compliance isn’t just the right move. With available tax incentives, it’s often the financially obvious one.

“I Didn’t Even Know My Website Had to Be ADA Compliant.”
Most small business owners learn about ADA website requirements the hard way — with a demand letter or lawsuit. There is no size exemption under ADA Title III. Serial plaintiffs specifically target small businesses because they’re more likely to settle quickly to avoid legal costs.
too small to be sued.
E-Commerce is the #1 Target for ADA Website Lawsuits.
Online retail represents 69–84% of all ADA website lawsuits filed in recent years. Inaccessible checkout flows, product images without alt text, and unlabeled form fields are the most common violations. Major brands like Domino’s, Fashion Nova, and Sweetgreen have faced years of litigation.
accessible to everyone?
Your Law Firm’s Website Is a Public Accommodation. Does It Comply?
Law firms are public accommodations under ADA Title III, and your website is your primary client-facing interface. An inaccessible firm website creates a reputational contradiction — especially if your practice involves disability, civil rights, or employment law.
you preach.
Courts Have Spoken.
Compliance Is Not Optional.
Federal courts and the DOJ have repeatedly affirmed that ADA Title III applies to business websites. Here’s what you need to know.
The Landmark Case That Changed Everything
After six years of litigation, the Supreme Court declined to hear Domino’s appeal, leaving intact the Ninth Circuit ruling that ADA Title III applies to business websites and mobile apps. Domino’s paid millions in legal fees and was forced to remediate their entire digital ecosystem. This precedent applies to every business in America.
The DOJ Has Explicitly Extended ADA to Private Websites
The Department of Justice issued formal guidance in 2022 confirming that ADA Title III requires private businesses to make their websites accessible. In April 2024, the DOJ finalized a rule mandating WCAG 2.1 AA standards — signaling mandatory standards for private businesses are next.
$1M Fine Proves Overlays Are Not Compliance
The FTC fined overlay company accessiBe $1 million for misleading claims about ADA compliance. Businesses that relied on accessiBe were left exposed. This ruling definitively established that overlay tools do not satisfy ADA requirements — only genuine code remediation does.
Serial Plaintiffs Make “Too Small to Sue” a Myth
Just 188 plaintiffs filed all 2,014 ADA website lawsuits in the first half of 2025. These serial litigants use automated tools to identify non-compliant sites at scale, then file in batches. Small businesses are specifically targeted because they’re more likely to settle quickly.
Real Businesses.
Real Protection.
We received a demand letter threatening an ADA lawsuit. Shure Business had our site fully remediated and documented within two weeks. When our attorney responded with the compliance certification, the plaintiff’s attorney dropped the case immediately. Worth every penny.
As an e-commerce store on Shopify, we thought we were protected. Shure Business’s audit revealed 89 accessibility violations — including in our checkout flow. They fixed everything at the code level. Two months later, we had zero concern when a competitor received an ADA lawsuit demand.
Our employment law firm’s website had multiple ADA violations — ironic given our practice. Shure Business remediated everything and provided compliance documentation we now include in client onboarding. We’ve since referred several business clients facing ADA website demands to them.
